I don't think the repair company will replace the camera but you might have something there with the replacement battery thing. I do have several third party batteries but they are not low when the shutter goes haywire. But I will pay closer attention. I am sure they will "fix" the issue when I send it in, it just upsets me that I sent it in twice while under warranty for the same thing and they sent it back saying it was fine, now its out of warranty and its going to cost I'm sure to repair it...

First freeze

Body is less than three weeks old. Firmware was updated immediately. Pentax battery in camera, third party battery in Pentax grip. Both batteries on about the second charge. Froze until grip was removed and body battery removed and then replaced.

Mine is sent back. It is on its way to B&H. Hope to get something better back from them. Good luck with your K-5. Does it freeze without the battery grip?

My new body has no issues at all. If it is the second rate battery that causes the freezing up that is easily fixable but the shutter sticking open, thats another story

Don't know if this helps but mine did the same when I first got it, now it's fine. Always did it on a fresh charge of the battery too.
Same here.

My 2-day old K5 froze once while I was doing dust removal. I removed and then re-installed the newly charged battery and everything was fine. The dust removal worked. I've never experienced any of my other Pentax cameras freeze (*ist DS, K200D and K7). After reading this thread, am I right in assuming that the K5 is more prone to freezing than the older models? Am a bit concerned.
