The catch is that the retailer will want to send it to CRK to test it and verify faults - so while you may technically be able to demand a refund or replacement on the spot, the reality is that it might be a bit harder to get them to do it.

Thanks Wheatfield, its now in their hands, just waiting for a reply from the camera shop as to what happens next. I have told them I want it looked at and not waiting for a reply from Japan as to whether a problem exists.

It is a big concern of mine. I purchased it in January to have a bit of time before the trip. I suppose I will take the K10D on its own.

I may need to ring them myself if I dont hear back from the store in the next few days.
