Is the mirror up when in Live View?

Yes, the mirror has to move out the way for live view to function. This also means you cant see through the OVF.
But the shutter is still connected to the mirror action, so if you take a photo in live view, the mirror will still move (I think this goes for all Pentax DSLRs at the moment)
Notable is the Pentax K-01 cameras which has no mirror (aka mirrorless), and is constantly in live view. Has no viewfinder.

Take off the lens, start the camera and see for yourself. You can even see the SR working and see how different it moves depending on what focal length you put in.
