I know that the 2 birds together are Bald Eagles. The small one with its prey is either a merlin or harrier Someone in Pentax Nation is sure to know.--charliezap

The first type seems to look like a hawk or a falcon. Maybe it is a young hawk.

After looking at several pictures, I tend to agree with pichaser. Looks a little more like a Merlin.

It would be great to I’d the prey but a Merlin is only about 10 inches long, so unless the prey is smaller than a chickadee, it suggests a much bigger bird than a merlin

Thanks all for commenting. It looks like the merlin gets the nod.--charliezap

Charlie, Nice images there! Might I suggest a very good resource for identification of Birds> allaboutbirds.com by Cornell Lab

Photos and Videos for Merlin, All About Birds, Cornell Lab of Ornithology

Theres also a phone App

Merlin Bird ID by Cornell Lab - Apps on Google Play

hope that helps for future Ids..

As much as I've been avoiding it, the dark eye and yellow around the eye looks like a Merlin. The Coopers Hawks would all seem to have yellow eyes, this guys eye are dark.

I might revise this, to perhaps a sharp shinned, as the proportion of wing length to tail length is closer to that of a sharped shinned,

It has also made me also consider again the OP is correct as a Merlin as a sharp shinned is much closer to the size of a Merlin

It would be easier to tell with an adult bird.

Of a sparrow, or a Finch.... small differences, sometimes that you can't see in the photogtgraph, make a difference sometimes. I know the difference between a female purple finch, a redpoll and a pine siskin, largely from observation. Same with many sparrows.
