Q not retaining date or updates

So I had a q without the battery in it for a few weeks and went to use it and the date and time was reset....so I thought ok , battery has been out no big deal so I set it up again...as soon as I turn it off it resets back to 0 and also doesn't have the latest firmware anymore...any ideas I haven't thought of other than it's broken

Amy: Just a shot in the dark - fully charge the battery, install it and let rest for a day. Do a factory reset (like clearing the registers in the old days). Then try again. I've had a similar freaky experience that i resolved that way, and I had a weird one-off where one of mine wouldn't stay ON. I cycled it seven or eight times and then it did. Go figure.

unfortunately no go so...not real excited about dealing with CRIS and waiting...have they completed their move or whatever has delayed their service..anybody know?
