Instagram has the right to sell your photos

And there's no way to opt out of it.

I doubt that very many here use Instagram, but I'm sure everyone knows someone who does.

Read the link from Cnet. I suspect that Facebook.com (Who now owns instagram) will soon adopt this.

One more reason to outright dump FarceBook... Folks need to delete all of their Instagram content and delete their accounts before 1 Jan to avoid giving away their photos.

Good find Ed. Have to agree with Mike on this one - delete your content and kill your membership before 1/1/13.

Wow, can Facebook do that same thing? In that case they won't see any images from me anymore.

Not yet, but I'm pretty sure the TOS change is imminent.

Agreed. This is (yet another) reason not to go anywhere near Instagram.

If they do it for a subsidiary it is logical that the TOS will roll up to FarceBook itself. Zuckerburg seems to think that his empire is too big to fail but one of these days he's gonna drive the final nail in his own coffin... this move is just one more plank in the coffin's construction.

Folks keep saying that these online resources are too big to actually use their photos and there is no risk. If that is the case then I have a question - why would Facebook and other providers pay lots of money to high powered attorneys to change their terms of use if they had zero intent of using any of the pictures ever?

I predict anyone with a shred of photographic talent is leaving that site. Good luck to Instagram in selling duck face photos and pictures of clouds... lots of clouds.

Who the hell cares, it's just a bunch of crap "photography" anyway. Maybe .0001% have some artistic merit...

I want my wife to post some of my photos to Instagram. Wait for Instagram to collect pennies from one of the photos. Then sue my wife and Instagram in an RIAA-type suit for copyright violations plus emotional damages. I'll forgive my wife's portion of the settlement

No, that's not my real financial plan but I would like to see some people take this angle to discourage the "we own anything you post online".

Anytime I do a photo shoot with a Model, I not only get a models release but issue a License/Usage agreement to the model. Both Documents are signed by both parties.

I'm considering adding this verbage to the License/Usage agreement.

Your thoughts?

"Posting of images of which I am the owner of both copyright and intellectual property rights on Instagram.com will result in revocation of this agreement and could lead to my imposing legal remedy."
(Or, something similar drawn up by my Attorney.)

Could be interesting if Instagram sells a picture, without a model release (and how many pix with releases are posted to Facebook/Instagram?), and the person in the picture recognizes themselves and sues.... We photographers can get ourselves in massive trouble that way, why not Czar Zuckerburg?

Wow! How can they even do that? It is appalling a little bit if they are actually going to do this.
Anyway, never used it ... definitely not going to use it .
