No matter what a staffer says, they can't make you delete photos

VP Biden's office has apologized for a staffer who forced a student reporter to delete photos taken at an open campus event.

Hopefully, Mr. Barr had the good sense to use an image recovery program to undelete the images.

Just remember, if you are ever in this situation and you don't feel like putting up a real argument... delete the photos as asked and immediately pull the memory card for safe keeping. The photos can be easily recovered as long as you don't take more photos on the card.

Thanks for posting this, it is my understanding that while you can be asked/told to stop taking pictures, in most cases you can not be told to delete what you have taken. This is a great idea about pulling the memory card and recovering them later.

I carry a copy of this Bert P. Krages Attorney at Law Photographer's Rights Page with me at all times. As I understand it you cannot be required to give up your images or film or whatever taken in a public place or public forum (and what constitues such is surprisingly broad) without a court order. Joe Biden ought to take the offending staffer out back and give him/her a spanking.

No, I think it's right on the money. A hysteric drunk on his self-perceived power. Barney Fife is their Patron Saint, or at least their Poster Child.
