Hopefully Australia has their own version of the American Civil Liberties Union (ACLU) that can be persuaded to take up this case.

This is absurd. The judge flipped from not guilty to guilty, and it appears that he completely ignored the law and the rights of the guy with the camera. Since the proliferation of cell phone cameras it is quite common to see people holding them up at arm's length (a technique that goes against what I was taught regarding proper support of a camera) squinting at the screen and snapping away. I would bet that the amount of pictures taken daily worldwide has increased 20 fold since the addition of the cheap cameras to phones.

What really sucks is that, as the article states, the defendant doesn't posses the financial resources to appeal the verdict, and now the legal precedent has been set. So the outcome of future cases will hinge upon the result of this case.

Time to make your gear more stealth.

My favorite part of this whole case is that the evidence used against the guy...was a recording of the event! His lawyer should have been all over this. This poor guy got screwed.
