I've heard via NPR that Apple asserts that the rectangular shape, with rounded corners and edges, is a patent protected feature of the iPad, and the fact that the Samsung sports a similar shape is thus an infringement. Well, let's see. The Asahi Pentax had a pentaprism housing which closely followed the prism it covered. The Canonflex and Nikon F had similar pentaprism housings and were introduced well after the Pentax. Does Pentax have an actionable claim against Nikon and Canon?
Is it not possible that products fuffilling similar purposes will have a certain similarity, even if made by competitors? And that these similarities are not the result of intellectual theft, but rather of good old "form follows function"? Would Trek bicycle sue Cannondale over the
two wheel issue?
