The saying "There's one born every minute" springs to mind here. You're absolutely right about it being potentially lucrative.

I've seen photog's work harder for less .... if she she gets three photos that sell for every hour she's there that's $30 an hour even one an hour is a better hourly wage than working at the Hallmart store and probably more fun, ... or one owner pop for 5 photos each morning and after noon plus making contacts for sitting sessions it is probably more a bit more lucrative than you think .... proud pet owners are as bad as grandparents about buy pictures of their precious ... I worked for a video production company when i started out in the early 90's and we video taped a childrens orchestra for a school district .... they crammed every kid in first an second grade onto a stage played 5 songs and it was done. the kids were crammed so close they would poke each other in the head with their bows easily a hundred fifty plus kids we panned the camera three times across the group each song so the parents/GP could see their kid, played back a feed in the lobby and sold vhs copies in the lobby for 10$ each, the two of us would make a couple grand in one evenings work ...... high school graduations would net $18k in one Saturday ...

if there is money to be made of mementos some one will be there to do it ....
especially if they can do it out of their home and off the books

she's probably saw you had the picture, assumed you bought it at another event, and hoped you would buy some more from her ....

I would at the very least ask nicely that the picture in the display be properly credited. She may not even realize what she did is not very ethical.
Heck, why be nice. You should let her know that what she is doing in unethical and illegal. Just send her an email saying she is in violation of copyright laws and that if she does not take down your picture for sale, you will report her to the local district attorney and the US government office of patents and trademarks. That should get her attention.

As I said earlier, sending a DMCA takedown notice to her ISP will get her attention in one hck of a hurry.

Exactly. You do not lose copyright by displaying the photo in public. If we carried the opposing argument out to its logical conclusion, then no artist putting on a gallery show would have any copyright protections. I can photograph at a gallery opening, but I am positive that photographs of the works themselves (photos, paintings, sculpture, performance art, whatever) could only be used in a documentary/editorial context, and not sold commercially. You should ask her to stop selling the photo on her site, since she has no rights to the original image.

I might just as well record a musical performance and try to sell CDs without asking the band's permission first. That's called a bootleg.
