Well, communication would be more like the mail in days of sail than a conversation.
It never says whether or not they have any communication faster than light. But light's still faster than their ships, so they'd get a data-dump as soon as a radio signal could reach them. (It also doesn't say whether or not Earth has powerful enough transmitters or they have to wait for the ship to come within range, but they probably would.)

Hee, well, if people are going for a modicum of 'hard sci fi,' it's not hard to arrange things so they'll satisfy most sci-fi fans.
I think the only point of real confusion is some not picking up on Jake's brother having died on Earth before the trip even began, and maybe a lot about the moviemakers leaivng out details most would find boring.
