I can't believe Pentax/Ricoh will not demand from the testers that those preproduction untis have to be returned to Pentax/Ricoh

Either it is second hand or new.

If true this is the most unprofessional move by Ricoh/Pentax ever. they even lost control of lenses they have not yet released.

It also implies that 100% of all user of this lens are trying to sell after using ;-)

That seller in Burbank California also has a 645 lens on sale, a Q and a DA35.

I highly doubt that, as Alex Munoz would return borrowed prototypes to Ricoh (and he's a professional photographer, not an equipment seller).
IMHO the best case scenario (for the buyer) is: lens not available, would ship sometimes next year. Worst case scenario: no shipment, ever.

Look at his eBay feedback for past items sold - he's sold a lot of Pentax gear (including a 645D), plus pro lighting stuff ...

So what? There's no indication he's Alex Munoz, and Alex Munoz might not like the accusation that he's selling unreleased products.

Whoever he is, he's merely selling used test or review equipment. No doubt disposing of it on eBay would be within the terms under which the seller came upon such 'pre-release' equipment.

I have a question for the ambassador that maybe can read this.. You can sell the gear provided by Ricoh? I would think that the contract say "no" on any circunstances, but i dont have a contract with Ricoh or any other manufacturer, or say that after all test have been done you can dispose the equipment whatever form you want?

I'm not certain where the seller is located. I don't know what the rest of the world is like between Black Friday and Christmas, but the USA becomes a shipping / logistics nightmare during that time. I recently ordered a lens from B&H. As a member of United Parcel Service's "UPS My Choice" program, I registered the package with them, which causes them to send me an email every time there is a change in status (and I can "sign" on-line so I don't have to be at home when it actually arrives). They told me that it would arrive on Wednesday, then Wednesday morning I got an email from them telling me that it was still on a trailer in Indianapolis (3 driving hours from here) and would be late; this morning they told me that it would arrive sometime between 12:45 and 3:45, and according to their log, it actually arrived at 4:17. That was actually quite fast and efficient, but UPS has been working on building that kind of reputation. Some packages seem to disappear for the entire season. I can certainly understand why a merchant would isssue that kind of disclaimer at this time of year - don't sue us if it doesn't arrive in time for your Christmas celebration, because we don't have any control of that kind of thing at this time of year.
