Originally posted by ChristianRock But if this lawsuit is successful, the result will probably be the killing off of the Pentax brand. A brand that sells in the tens of thousands and has to pay off millions of dollars (including the lawyer fees) will probably - I think - make someone up high at Ricoh go "nah, no longer worth the trouble".
It is hard to say. I did some research and the suit is still alive with Ricoh USA as the respondent. Judges have been assigned and plaintiff is asking for additional time to prepare revisions as of earlier this month. I don't have specifics, lacking a PACER account.
FWIW, I would expect an award on the order of half the estimated purchase price of the defective cameras purchased alone. The purchase of additional kit is irrelevant. The $5,000,000 figure was stated to provide standing in regards to statute, but is not unreasonable. I don't know if failure to demonstrate $5,000,000 actual damage or the required 12,000 class members on discovery would result in dismissal out of hand. Much depends on whether depreciation is applied and available information regarding camera age at failure and number of failed cameras (i.e. the size of the class). Number of clicks is irrelevant as are total sales.
