One way or another,

what ever you'll say, I strongly believe, this lens was changed somehow, and it's reflect on the overall IQ.

I think this was not just my bad copy, when I've been told the "green ones are way better", and the "Pentax change manufacturer" / what ever this means, because lens is produced under Pentax brand.

This would be just nonsence from seller to say, if just I, and me only was had a bad copy, and non of this claims was true, doesn't it?

There is even threads and reviews on that difference, I've searched it, and you can found it if you want.

IQ from second ver, is lower in test of users, specially in terms of sharpness. I don't know which one of you have a "better, or good copy", but it's obviously overall true, about "quality" of the silver one

It is never up to the rest of us to prove a negative.

If you ever end up in court, do yourself a favour - hire a lawyer, don't try to defend yourself.

Note in the same thread it says earlier that the DXO numbers between the lenses are pretty much the same.

Sounds to me like the "seller" was just feeding you a load BS because he/she did not want to exchange the lens, as some sales people are known to do. Exchanging the lens could have cleared up whether or not you simply had a bad copy. Since you no longer have the lens we can only take your word that it wasn't labeled DA L or ver II. And since you no longer have the lens you can't provide us with sample photos.
