This sale is fine and in full legal agreement with the legal terms of use, given that original disc/box/documentation is included, and the software removed from your computer.

Carry on.

If you read the apple eula it can be transferred once even if opened as long as you include everything and remove it from your computer.
This applies to each owner subsequently. the new owner may do the same. Each "party" is their own entity.

This is designed to prevent "copy selling". note that the Apple eula uses the word "transfer", and not "sale". That tells you something. It is phrased this way to try and look like a restriction on commerce and trade.

There is no limit to how many times an item may legitimately change hands so long as the entirety of the product is transferred. It can be transferred multiple times. In both the US and Canada federal trade laws prevent limits on second-hand selling. That is: a sales contract cannot bind a current owner to an original owner, and so forth. This has been well-established through legislation and regulations, as well as jurisprudence regarding auto warranties. This is to make sure that capital investment can be re-sold as necessary. Imagine if a bankrupt company could not "transfer" its software assets to a creditor. The value of the enterprise would plummet ans the initial investment would be overly risky. There are multiple instances where new entities have to take over license ownership rights regardless of the wish of the original license issuer (Apple in this case). It happens all the time. The "one time transfer" stuff has no legal bearing.

This is an important issue. All cameras have software and are increasingly internalize mini-editing suites. Suppose an eula like this was attached to every camera? It would kill the resale market thereby dramatically reducing legitimate commerce in used goods and services.

There is a de facto market for software licenses and the court case referenced above illustrates this market reality. Software may be licensed, but a first sale cannot strip away the legal protection enjoyed by subsequent sellers of used goods.

If anyone is unsure whether Aperture is worth the investment, it might be prudent to read how Joe McNally, famed Nikon shooter, uses it in his workflow: The McNally Workflow.. | Joe McNally's Blog

I've been using it for a little over a year and have to say it's a huge improvement over trying to use Bridge to do my editing and photo archiving. I've been testing the beta download of Lightroom 3 and have to say I still like Aperture better.

Ari didn't buy it for some reason (said because it took me a day to respond he moved on), so Aperture is still for sale.
