Can I sell

Hey,

I took some pictures for a Culinary School at the begining of this year, assignment basis (for free). Can I still sell prints of those pictures? (No People) It's would be of the food.

By the way I didn't get a property release is that O.K?
The pictures won't show the property but it was taken on it lol

As far as I know you don't need a "Model Release". Secondly, and again I might be corrected, since there was no payment you hold the rights UNLESS there was prior agreement as to ownership.

IIRC even if there were people, selling them as art is permissible without release under US law. But just objects the only issues I could see is selling the image to a commercial entity for the purpose of product promotion. The school might object to its product being used to commercially promote another. (assuming that its uniquely identifiable.)

To take the picture? Absolutely not.

Most of the issues come when you want to publish. In general pictures take for "art" or journalist intent are free to print most anything without releases. Its when you start making commercial use of your images that you have to worry more about it.

There are a couple threads on the law surrounding photography floating around. You should read them.

Well taking the picture and selling to two very different acts legally.

Since you can read the words, do you need permission from the author?

As GeekyBiker noted, there are threads on this forum about photo publishing and rights issues. Before you do something that might bring expensive lawyers down on you, you might want to know what not to do.

As to selling photographs of "famous books," you might begin with the copyright page near the front of the book. Read it through, and look for any language about reserved rights, such as "all rights reserved" or "no portion of this book may be reproduced...without the express written permission of the publisher," or something of that sort.

In most commercially published books, you'll find some such statement that basically means "it's ours, and if you want to sell a copy of anything in it, you better get our permission first." At least, begin with a clear understanding of the difference between "editorial use" and "commercial use" of others' intellectual property. I'd hate to see your early steps toward a career in photography thwarted by the sort of mistake in judgment that attracts publishers' attorneys your way. Take care!
