I would not worry about it too much. Copyright has not been breeched if he downloaded for his own use...IE on his computer, and his edited photo was a forum reply to the original you posted.
He does not automagically have the right to edit her photo and publish it. Unless thats stated in the forums EULA when you sign up that everything you post is public domain or whatever.

Then ofcourse it depends on where the forum is located and what the local copyright laws says. But generally in the west, it is phorbitted to reproduce material without an agreement from the author and/or the copyrightholder, in this case the photographer.

Then again, there are alot of hobbyist lawyers on the internet that like to make their own laws and apply them here and there.

Have no idea about copyright laws, but just wanted to tell you that your daughter is simply precious and I think the photo is outstanding! Her eyes are gorgeous!! He must be jealous because he doesn't have such a beautiful subject to shoot. BTW...I love your response to the situation as well (very funny).

I know the english also used the term Yankee about the, oh how should I type it so that I do not offend anyone, The fighting citizens of the United states of America. Just because that was what they were, the fighting men, both on the pubs and the battlefields.

So basically, if I have offended any southern slave supporting citizen of the united states of america by calling them a non slave supporting citizen of the united states of america, I hereby declare, I have no intention to apology to anyone that supports the cause of the southern states of america in the civil war of the united states of america. Because frankly, I can't respect anyone that supports a war for the right to own slaves.

And if you are a Northern citizen of the united states of america and find yourself offended by me calling you a yankee, consider why you are offended of a word that your forefathers used on themselves when they fought the evil of britain and the evil of the southern states. How would they feel if you are ashamed of their glorious deeds?

Good day to yous, yankees and non-yankee citizens of the United States of America.
Congratulations on a marvelous job of missing the point entirely. Or of deliberate obtuseness, as the case may be.

Imageshack is not a fly-by-night company, nor are they stupid - they understand the legal consequences of idiots posting images that could be conscrued as harassment or violation of copyright. Their terms of service are very clear, as posted on their website under the Terms of Service:

ImageShack® Terms of Service
Short version of the ImageShack® Terms of Service:
Don't upload anything that can be even remotely construed as porn, copyrighted material, harassment, or spam. If you do, we will ban you, delete all your images, and prevent you from viewing any images hosted on ImageShack®.

Sounds pretty straighforward to me. For the rest of their ToS, here's their link:

At your request, I have considered why I'm offended, and I've concluded that it's because you have intended to offend me. FYI, the only way Americans (from any region) would take offense at being called, "yankee," is when it is intended as an insult by someone like you.

Having said that, many of us have grown accustomed to dismissing the puerile insults directed at us from people who presume that their own "enlightened" nationality somehow renders them intellectually or culturally superior to all us boorish Americans. Frankly, I'm more offended that you own a Pentax than I am at your flaccid attempt to insult the people of my country. I find no reason to be upset with your comments, although I do enjoy the poetic irony of being sneered at by someone who -- in his very attempt to blindly denigrate another culture -- so plainly betrays the authenticity of his own worldly wisdom, and reveals in himself the very intellectual shallowness he seeks to project onto others.

Do yourself a favor, friend -- step out from behind that façade of cultural enlightenment, put down your textbook with the 2 chapters on American History and politely excuse yourself from that comfy echo-chamber of anti-Americanism for a few minutes. Take a breath, relax, and see what happens when you stop projecting your own feelings of inadequacy and superiority onto others, and start acting like an adult.

No. I did not intend to offend anyone. I often use yank, because it is a short word as you can see, since i overuse "Citizen of United states of America" which would be the proper name I guess. Just as I say, scot about scottish people, Ukanian about UK people (indeed my own word). Swede about swedish people.

I hardly see myself very enlightened. I absolutely do not see Sweden or it's people enlightened at all. Infact, in many ways I despise aproximatly 60% of the Swedish citizens. I do not have alot of good to say about our historical acts nor present. And I'll give you that, I do not have alot over for alot of countries and their political moves either, including the United states of America.

That being said, I am not a anti-USA zealot either. I know there are good people there and I know there are bad people there, just as in any other country. And I am sure that if you really read what I said in the first post, you would agree, I hope, that there is alot of yanks, that do infact think their laws and their cultural values are global. (writing that sentence made me think of another thread in another forum where a yank did infact wonder, sincerily, why UKanians did not celebrate 4th of july).

So going back to the main issue here, I still assume that the poster that meant he did not break any copyright laws, because she had posted the image first in a forum thread and he was thereby clear to republish it as he wanted, must be a local law (or a local misconception) that he, obviously considering he typed what he typed, think is the same everywhere.

I am quite sure I have read more about the history of the united states then you have about Sweden. Possibly even more then you have read about Europe. Don't forget, your legacy, your culture and your values springs from Europe.

As for me, yes, I do consider myself quite up to date with politics and history. And yes, I do not approve of alot of the politics carried out in the USA. But do I blame the people of USA for it? Not really, except to the point that they are electing, more or less, the politicians that carry out the politics I do not approve of. And I am always skeptical to patrioism no matter to what state or gouverment it is. I am quite sure for example that the Queen of England is infact the root of all evil. And no, my english friends do not agree.

You still don't get it. It has nothing to do with the word "Yank".

One person does something offensive/bad/stupid. You immediately assume the person is an American.

Not only are you willing to besmirch 300+ million people for the acts of one.....you're ready, willing, and eager to do so without any evidence or knowledge whatsoever that the one is an American or not.

And when you have your own offensiveness pointed out to you, you feign ignorance and go off on a totally irrelevant tangent about slavery, of all things.

Mom, your daughter is really cute with very intelligent eyes.

You can tell that she is totally amazed by everything around her. As I would have been at her age.

No. When ever someone comes out telling people what laws and rules apply to internet I assume they are a yank. Because 99% of the hobby lawyers are yanks. I don't know if it is because of the overly intresting legal system you have or why people in USA is so intrested in lawyer stuff.

I never said 300 million people is like that person. Nor did I say that there is 100.000 people that is like him. What I did presume and if I am wrong, thats all jolly, is that HE is one of those that constantly like to interpret and spread HIS made up laws as a universal truth. No matter what forum and what the "offence" is, when I get legal advice I don't want, it comes from either a made up paragraph or from a paragraph in some odd lawbook from any given state of USA.

Well, I can only blame that on language barrier problems, I really read your post as you were insulted by the word "yank" .

Gooshin, that made me laugh my A** off!

Anyway, momphotographer, two things:

1) That baby does not look demonic in the slightest, in fact she's extremely cute, and
2) I think you yourself have some very good photography skills. That's an
incredible capture.

Anyway, the net effect (pardon the pun) of having that photo with that caption out there will probably be that a whole bunch of people will see it and say "awww, so cute!"

A lot of times I see shots of cute babies with funny non-sequitur captions that don't fit the photo at all, and they're just harmless and funny. Don't worry too much.
