DA 40mm for $251 at ebay

Looks like the seller: electronicsvalley has tons of DA 40mm for sell in a much cheaper price... new too?

Trustworthy?

Ratings looking legit..

Received the XS. Complained in an eBay message that the item was not as described and requested an exchange. Called their customer service and was notified that the DA40 Limited was not in stock, but she would double check and call me back (still has not as of this writing). Recieved RMA and a UPS return label in email, I plan on shipping it back today.

This sucks. If this is the trend the seller will likely get a lot of negative feedbacks...

So that's why I shouldn't be surprised I haven't received a tracking number yet...

Well, I can't complain too much since I knew what I was getting into

The item was removed by eBay from listings. You can not complain about the item number any longer because eBay removed it as a listing so you can only file a formal claim through your purchase link.

In short, they made a mistake because they probably didn't really know what they had bought, and now instead of standing by their mistake they pull the listing and try to convince the customers they made no mistake.

Happens all the time on the web. Even Amazon does that. That's the downside of buying online.

Their fault, my fault, no fault - I have never had Amazon do anything but apologize and allow me to print out a pre-paid return label without any fuss whatsoever.

FINALLY got my refund from them. No "Sorry", no nothing. Zero correspondence from the seller. I've never had a situation with any seller where I got nothing from them and it all came from eBay or PP. Sad, just plain sad. Never will do business with that company no matter what they claim to be selling.

I was caught too, just mailed my xs back to them yesterday. Collectively, we have grounds to sue as a class action. Are any of us actually in New Jersey to go see a lawyer in person? If not, we could do class action at a distance instead of small claims.

Since we had a sales contract, and they took our money, they are liable for the difference between $250 and what we would have to pay someone else to fulfill the contract, in this case, the lowest retail price we can find advertised. We could probably push for punative damages also, since it was classic bait and switch. If we can get a head count of who all got screwed here, that would be useful.

I encourage everyone who did buy the lens to pursue this, and not let the matter drop. Escalate it with eBay and indeed why not bring it to court? If scammers have a hard time getting away with it, maybe they'll stop.

I'm sorry it didn't work out for you guys (though it makes me feel better about having bought a secondhand DA 40 on the forum for a reasonable price a little while ago).
