Its a good thing Pentax chose MJPEG.

Besides the ease of editing and lower cost to build, there is this very interesting article discussing one major pitfall of H.264 (Although sadly it doesn't mention pentax in the article) Why our civilizations video art and culture is threatened by the MPEG-LA

One can put just about anything you want into a software license agreement. It is generally considered that a lot of what is in most of these agreements is not enforceable (assuming both sides are about equal as in can spend about the same amount of money). This one seems to be about the same as inventing a new paint pigment and printing on the box that you have the rights to some of the money you get when you sell the painting. This would seem to be out side of both copyright and patent law intent. This leaves only contract law and as it is imposing a contract on a secondary non-participant to the contract to is also probably unenforceable. All of this looks to be outside existing black letter law and is thus moot. This is where lawyers like it, as this is where they (on both side) make money and everyone else pays.
