dcxpert blocked me in ebay: C.R. Kennedy & Company not affiliated to dcxpert

As I understand it, though, the issue isn't the refund... it's that DCXPERT blocked you from being a future customer on its eBay account, yes? I agree that it seems a harsh and unfair course of action in the circumstances, but so far as I know DCXPERT is within its rights.

From eBay:

QuoteQuote:

eBay sellers have control over who can bid on and buy their items. You can block individual buyers or set buyer requirements based on specific criteria

If you've had an issue with a buyer and don't want them to purchase or bid on your items, you can add them to your Blocked buyers list. They'll be unable to place bids or buy from you until you remove them from the list.

The highlighted portion is the important point here... A seller can block whoever they like; they don't need to have (or give) any reason :o

We don't know that Brian doesn't have an ABN. He might have one in his own name (if he is a sole trader). Or he might have incorporated. We don't know his surname, or any company name, and he doesn't put an ABN or ACN on any documents. Which he ought to do, if he is actually the seller, whether he is a sole trader or operates through a company.

Also, whether or not he is entitled under the Australian Consumer Law or under ebay rules to block a customer who exercises their right to return an item (I don't know the answer to this), it seems to me a discreditable practice.

It's true that most (all?) of the products that dcxpert sells are products for which CRK is an authorised distributor (e.g. Pentax/Ricoh, Sigma, Lensbaby, Tokina, Kenko, SLR Magic Cine, Vanguard, Slik, Sandisk, ifootage, Crumpler, Black Rapid, Calibrite, Kowa, Minox, etc etc).

But you said that CRK told you that Brian runs dcxpert and is not affiliated with CRK. I've had emails from Brian about purchases from dcxpert. He might be a fictional character, but it seems unlikely.

It is possible that in the unlikely event that a consumer dispute over a sale by dcxpert ever went to court, and all the background came out, dcxpert would be treated as an agent of CRK (whether or not that is what Brian or CRK think the arrangement is). If I were CRK, and didn't want to be liable for what is done by dcxpert, I would be taking steps to distance myself from Brian - including ensuring that he issues invoices/receipts with his own details (including ABN/ACN) on them. I wouldn't be sending CRK invoices for dcxpert sales or sending emails in the name of dcxpert.

Toorak eh!? Poor buggers. :(

I call on all Aussie Pentaxians to shun DCxpert, and shift their purchases to CRK, the poor people need all of us to support them given the horrific living expenses of Toorak - why, they might even be renters ...:eek:

Just to be clear, that was a rumour I read elsewhere (more than once, admittedly). I'd take it with a pinch of salt - but I also think it might be possible...

Well... here in the UK, ex-display (as opposed to ex-demo) and damaged-box items can be legitimately sold as new (I've had a few of both, though I knew when ordering as the dealers were transparent about it). Customer returns? I'm not sure... Since distance-selling regulations allow no-reason returns within a specified period, I suspect if they're returned in unused condition they might be resaleable as new (otherwise the retailer loses money for no good reason). Either way, if the item is checked to be functionally and cosmetically perfect and the serial number hasn't been registered for warranty purposes, who's to know? I'm not suggesting CRK / DCX would do that... but I'd take a wild guess at least some dealers have in the past. Still, if an item really is functionally and cosmetically perfect and supplied with full warranty from the date of sale - and I too have the option of returning it if dissatisfied - would I care? Probably not... Ignorance is bliss :p I've bought a few "open box" items in the past and generally been happy with them. I ended up returning a couple of lenses that were de-centred, but that happens with brand new copies too. Furthermore, I'd hazard a guess that many "grey market" cameras and lenses that folks buy on eBay and the like may be open-box / customer returns... but if they're functionally and cosmetically perfect, no-one's the wiser and everyone's happy enough :)

It's been a while since I bought any brand new gear. The last item was a heavily-discounted HD FA31/1.8 Limited, bought from WEX Photographic (a reputable UK dealer) last year, and the box for that definitely wasn't sealed, but the item was clearly brand new (even the plastic bag protecting the lens was crease-free). I bought an HD FA35/2 from Amazon UK in 2019, and I believe the box for that wasn't sealed either - but I can't be certain. Again, it was clearly brand new and the box contents as packed at the factory...

This part I can shed a little light on... pjv leaving the forums has been coming for some time. It was entirely his choice and had nothing to do with this DCXpert thread in particular. We exchange e-mails every few weeks or months, and did so last night. For anyone interested, he's doing just fine :)

My Pentax bodies and lenses are older than yours (except for one) but I've thrown in the towel on PDAF, so my solution was to adjust my expectations. Maybe I'll try again someday if I get a mirrorless body, or a dslr body/lens combination that allows multiple PDAF adjustments at different focal lengths and maybe focusing distances.

My experience is that at 3 meters focusing it is still pretty close to stated focal length. Minimum focus distance is around 1 meter and certainly you don't get a lot of extra magnification at that distance, but this isn't a macro lens by any means and if that is the goal, probably look elsewhere. For portraiture or landscapes, it is really nice.
