Has Pentax abandoned PEF? Time to switch to DNG?

Take a deep breath and relax. It is probably a language barrier thing. However, it is simple, Pentax has decided to drop PEF under Ricoh. Whether that would have happened if they remained under Hoya, we will likely never know. However, the point was made that newer PEF files aren't recognized in older versions of CS such as CS3 whereas DNG files are. The only advantage PEF had was size and that went away as dng became compressed by cameras that use it, but not all use it.

Adobe is a Corporation. It isn't like they are GIMP. I have wondered if Adobe's ulterior motives may have been to assimilate and displace TIFF which was already a standard when their dng project began. I also wonder if Canon, Nikon etc. will ever adopt it.

I wouldn't count on the Feds picking there noses. It took a Georgia sheriff to look into one of the NBPP. One of the guys that announced the $10,000 on CNN got busted for weapons violations. Imagine that, a convicted felon with guns. Typical of criminal organizations. Get gun laws screwed down on law abiding citizens, and put pressure on them so it is difficult for them to counter. Even the Southern Poverty Law Center considers them in the same category as the KKK.

Bond set for New Black Panther leader in weapons case

Actually there are people killed like that. Go out and lay down on a side walk and have some one get you by the ears and pound your head on it until you pass out from a concussion. Then that person can search for money, knives and guns. Ever had a concussion that made you puke for 3 days?

Do you have any data to back this up? No you don't because they are rare occurrence. Furthermore, the current statute has been in place since 2005. However, if you want to look at innocent bystanders getting shot, I suggest you look at the news reports in Chicago such as the 6 year old girl last week. Those sorts of events happen with frequency in Chicago.

However, this kind of thing happens frequently in Florida. It has happened here in Tallahassee frequently. The is regarding the Shootout at the Circle K Coral in 2009. There has been 4 trials, 1 more to go. The first 4 would have walked if it hadn't been for Florida's lax gun laws (sarcasm intended there). They got 20 years for pulling one.

According to the current State's Attorney that replaced the one that withdrew from the case over the weekend, there was 50 pounds difference in their weight. Zimmerman is 5' 9" and 200 pounds and Martin was 6' 2" and 150.

I wasn't debating the ethics or stupidness of Zimmerman. However, the Police stated that it wasn't a legally binding directive. See the provide links. No, people hunting isn't legal in Florida. Nor was I debating whether or not Martin did anything wrong. However, there are 2 witnesses that saw Martin beating the crap out of Zimmerman. As per the other statute I posted above, Zimmerman wasn't obligated to allow Martin to finish beating him to a pulp, whether he started it or not.

Actually, your assumptions are incorrect. From the police:

QuoteQuote:

If Zimmerman was told not to continue to follow Trayvon, can that be
considered in this investigation?
Yes it will; however, the telecommunications call taker asked Zimmerman “are you
following him”. Zimmerman replied, “yes”. The call taker stated “you don’t need to do
that”. The call taker’s suggestion is not a lawful order that Mr. Zimmerman would be
required to follow.
Zimmerman’s statement was that he had lost sight of Trayvon and
was returning to his truck to meet the police officer when he says he was attacked by
Trayvon.

Go here for all the stuff regarding the Sanford PD investigation that has been made public. You will see there was an on going investigation with files turned over to the States Attorney. (The State's Attorney withdrew over the weekend and there is a new one due to the controversy which may actually be a set back to the case.)

City of Sanford

Plus, there is this Statute. Regardless of who threw the first punch, which is unknown for sure.

QuoteQuote:

776.041 Use of force by aggressor.—The justification described in the preceding sections of this chapter is not available to a person who:(1) Is attempting to commit, committing, or escaping after the commission of, a forcible felony; or
(2) Initially provokes the use of force against himself or herself, unless:(a) Such force is so great that the person reasonably believes that he or she is in imminent danger of death or great bodily harm and that he or she has exhausted every reasonable means to escape such danger other than the use of force which is likely to cause death or great bodily harm to the assailant; or
(b) In good faith, the person withdraws from physical contact with the assailant and indicates clearly to the assailant that he or she desires to withdraw and terminate the use of force, but the assailant continues or resumes the use of force.

Yes I have. Have you? Have YOU listened to the entire Zimmerman recording? Do you here where he said "ok" after the dispatcher told him they didn't need him to follow and later where Zimmerman said he lost sight or him and asked to have police to call him when he got there?

Obviously, will have to be analyzed and probably has been. However, the witness told police as well is on a taped recording by the news team saying he was on top of Zimmerman. That is one of the same witnesses that called 911. Yet you say they are lying. Zimmerman had grass on the front and back of his close, busted nose, and had a cut on the back of the head.

Here is my point. You nor I no what went down after Zimmerman got of the phone with the dispatcher. It all happened within a matter of 5 minutes. There is a big difference in what you or I THINK and what you or I know.

Actually, it is illegal to even threaten to use a weapon (doesn't matter if it is gun or knife) by waiving it or mention it to gain leverage in an argument. Even with a ccw, it is a minimum of 3 years. As far as the stand your ground aspect of the statute in question, no where does it say you can shoot, stab, cut or hit first. In other words, you can't just shoot or stab someone for merely being "scared." You have over looked the part about meeting force with force.

How would he have known Zimmerman was armed though. Plus, how do you know Zimmerman grabbed him? There was a witness that put him on top of Zimmerman and also stated that live on the news to a reporter. This same witness claims it was Zimmerman that was yelling for help.

Again, that is the issuing agency for a concealed carry permit and Zimmerman signed that he understood this when he got his permit. But if you look, they often do list at least one case law at the end of the q&a. The ccw site is the official ccw site and the legal opinions of state attorneys based on Florida case law.

Like this one, already posted (this time with a case example:

QuoteQuote:

Q. What if I point my handgun at someone but don't use it?
A. Never display a handgun to gain "leverage" in an argument. Threatening someone verbally while possessing a handgun, even licensed, will land you in jail for three years. Even if the gun is broken or you don't have bullets, you will receive the mandatory three-year sentence if convicted. The law does not allow any possibility of getting out of jail early.
Example: In a 1987 case, a woman refused to pay an automobile mechanic who she thought did a poor job repairing her car. They argued about it, and the mechanic removed the radiator hose from the car so she couldn't drive it away. She reached into her purse, pulled out an unloaded gun, and threatened to kill the mechanic if he touched her car again. The mechanic grabbed the gun and called the police.
The woman was convicted of aggravated assault with a firearm and sentenced to serve a mandatory three-year prison term. The fact that the gun was not loaded was irrelevant. Even though she was the mother of three dependent children and had no prior criminal record, the statute does not allow for parole. Her only recourse was to seek clemency from the Governor.

Of the 28 cases that went to trial regarding (3), 19 of them were found guilty and at least 22 cases are still pending.[/quote]

The Q&A is based on case law and statute by the issuing agency. Zimmerman signed that he was aware of these things when he got his concealed weapons permit.

Number of "stand your ground" cases rises as legislators rethink law - Trayvon Martin - MiamiHerald.com

QuoteQuote:

The Times analysis shows that more than 70 percent of the 130 cases involved a fatality. In the majority of the cases, the person who plunged the knife or swung the bat or pulled the trigger did not face a trial.
In 50 of the cases, the person who used force was never charged with a crime. Another nine defendants were granted immunity by a judge and nine cases were dismissed.
In 10 cases, the defendant pleaded guilty to lesser crimes.
Of the 28 cases that made it to trial, 19 people were found guilty of a crime.
Twenty-two cases are still pending. (The outcomes of two could not be learned by press time.)
The Times analysis also shows that "stand your ground" is being invoked with greater frequency.

Florida 'stand your ground' law results in no charges in fatal Hillsborough road rage stabbing - Tampa Bay Times

This is the most recent trial of a participant in a 2009 shootout at a Circle K where one was killed, 2 or 3 wounded and the store windows shot out. The Stand your ground didn't work because they were either convicted felons or juvenile delinquents. No one got pinned for murder but they got 20+ years on illegally concealing weapons and gun charges.

There is nothing to indicate that Zimmerman intended in harm other than wanting police to check him out. However, words alone aren't grounds enough to use any kind of weapon under Florida law. It would have been illegal for Zimmerman to show a weapon and threaten Martin and a class c Felony.

From the Florida ccw site.

Lawful Self-Defense - Weapons - Division of Licensing, FDACS

QuoteQuote:

What if someone uses threatening language to me so that I am afraid for my life or safety? A. Verbal threats are not enough to justify the use of deadly force. There must be an overt act by the person which indicates that he immediately intends to carry out the threat. The person threatened must reasonably believe that he will be killed or suffer serious bodily harm if he does not immediately take the life of his adversary.

It would have been illegal for Zimmerman to show a weapon and threaten Martin and a class c Felony.

You are trying to cherry pick it which is leading to your confusion. You can't ignore (a) and (b). Nor can you ignore (4)

QuoteQuote:

(4) A person who unlawfully and by force enters or attempts to enter a person’s dwelling, residence, or occupied vehicle is presumed to be doing so with the intent to commit an unlawful act involving force or violence.

Plus, there is actually a body of case law.

However, this is the part that applies to this case.

QuoteQuote:

(3) A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

There is case law in this area since 2005.

This is exactly what I have been trying to get across. If Zimmerman instigated the altercation, I want to see him held accountable.

The phone conservation with his girlfriend has mostly been filtered through the families attorney so we will likely not see the official aspects of this until testimony to the grand jury and/or during a trial.

They did have him in custody for a while and they know his whereabouts. The case was initially turned over to the States Attorney. After all the national publicity, fed involvement, and task force headed up by the Lt. Gov., the original state's attorney withdrew and a states attorney from Jacksonville took over. It isn't uncommon for arrests to be made after a Grand Jury hearing or other investigations. The could have over charge Zimmerman or under charged him which would have opened up other issues. Perhaps they should have arrested him on 2nd Degree at the time.

As far as the racism issues in this case, I don't think they are as great as made out to be. The neighborhood was 49% white. Zimmerman's mother is a Cuban.

Section (a) clarifies that.

QuoteQuote:

(a) The person against whom the defensive force was used was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle, or if that person had removed or was attempting to remove another against that person’s will from the dwelling, residence, or occupied vehicle; and

b) The person who uses defensive force knew or had reason to believe that an unlawful and forcible entry or unlawful and forcible act was occurring or had occurred.

That part doesn't really apply to this case.

You keep making the circular argument that we have already discussed. What a lot of people think and what is actually known are 2 different things. What I said, I and I will repeat for the nth time, it is possible that Zimmerman actually stopped when he was told it wasn't needed for him to follow. There is a recording of him telling the dispatcher that he lost sight of Martin and was at a street sign waiting on police. We don't really know at this point who the aggressor was. Nothing either party did up until the altercation was illegal.

I didn't say anything about him dragging him out of the truck. I said Zimmerman told the dispatcher he would be waiting for police by a street sign. Plus, I said IF Martin came back. He obviously didn't exit the back entrance to the development.
