Well, if you can’t see the difference... ;)
On problem is that "this obvious statement" obviously isn’t obvious. What you say seems to imply that a DSLR with a DA70 is so bad it’s on the level with a P&S. The DA70, is it really that bad? If you don’t see the difference between a P&S and the DA70, then... trust me. But I don’t think you really mean that, so what you are saying must have another meaning. The obvious is that you implicitly imply that those people that either does not see much difference between the 70 and 77, or if they see a difference still prefer the 70, are so hopeless, blind, stupid or whatever in your eyes, that they are not "worthy" of using a DSLR.

It took 5 weeks (in Norway) from I shipped it, until I got a replacement yesterday.
Now I have a "stainless" K-5. :D

Why should you need any clearer instruction? You should do what you normally would do if you find something wrong, and need to request a warranty repair or replacement. Usually one would relate to the dealer where the product was bought.
The 'sensor stains' is not a special case. The only thing special about the stain situation is that it affects more cameras than the usual, more or less random malfunctions or manufacturing faults. But for the end user it doesn’t matter. If my camera is affected by the stains (as it was), or it had a scratch over the whole sensor, or a rotary didn’t work, or something else, it doesn’t make my situation any different if I’m the only one or not. Even if there are 10.000 other people with the same problem, I would have to deal with it the same way.
Ah, yes :( I can understand they are not the best dealer to handling a situation like this, but that is not actually Pentax’ fault.

Yes, that database. Highest s/n suspected to have stains is 3959315.

What he did mean was that if it’s sent inn, and they find it’s not "stained as claimed by the owner", only dust, then one should pay for the postage, check and cleaning.

In the database, so fare there are no stains reported higher than 395xxxx
I.e so far no stains listed for 396xxxx and up.

Exactly. So why the drama then?
The OP has observed something he didn’t expect. He’s the kind of guy that wants to understand why unexpected things happen, and in this process have done some (semi-?)systematic tests to figure out how the K-5 works.
And, that 1/3 stop ISO doesn’t 100% equal 1/3 stop speed does not seem like a fully satisfying explaining to why the difference occur between ISO 160 and 200 only, and only when D-rang is turned on.
A/C flick. Maybe it’s a stupid theory, I don’t know. But if someone does knows better, then explain it.
CPU defects ??? No one said anything about CPU defect. Someone did say that "The in-camera number crunching ability is presently limited by cpu heat/size and battery power and not by cost." It’s a general statement saying that how much CPU power can be put into a camera (any camera) is not limited by cost, but by other factors.
This is a public forum where the level of expertise and knowledge varies greatly. Might be a challenge for experts to bear with the novices, but it would be a much better forum if experts (or is it "experts" ?) could explain things properly, instead of just putting things off as ridiculous.

Why such drama? No one is talking about conspiracy.
Not two different shots, but repeated test where the OP is seeing a systematic difference tied to ISO.
And, enoeske actually had saved that graph - for me. I haven’t seen it more than 10 times, and still find it interesting.

Open a photo (taken with your K-5) in PhotoME ( PhotoME - Exif, IPTC & ICC Metadata Editor )
In the long list under the main section Manufacturer notes, there is a sub-section with these parameters:
Pentax Model
Manufacture Data?
Camera has been serviced?
Production ID?
Internal Serial Number?
It’s a long list. Just scroll down to the bottom and then about three pages up again.

Yes, it might be a stain, but it might just be dust.
It’s one spot only, not the typical chain of stains, and the photos are too grainy to judge.
At the moment the camera is opened to put on a lens some dust may get in there. And a rocket blower does not "remove any possible dust". One might get lucky, but by blowing, more dust might get sucked in there or old dust shifted around and ending up on the censor.
I think one should at least take the time to do some proper shots (doesn’t take that much time).
Manually set ISO 100. Also, I think it’s better to manually set WB to indoor light (get a more grey/white shot instead of yellow). Just point at a well lit, preferably white surface (a sheet of paper on the floor, and move in so the sheet covers the frame). Don’t need a tripod or anything as it doesn’t matter if it takes 3 seconds and the camera is shaking - we’re not after a sharp photo of a wall.
Set focus to manual, and take one shot at infinity and one at closest focus. In the shots bellow it’s easy to see how the stains look different at infinite and closest focus. At infinite the large stains shows as black spots with a grey halo around, while the small stains shows up as blury dots. At close focus the large stains shows as large black dots with a dim light halo around them, while the small stains now shows up as small black stains with a grey halo.

Myself I think it’s easier to judge stains if manually set to closest focus. The “stain” gets sort of sharper then, and the distinct character of a stain shows up better. Also set ISO to 100. It doesn’t matter if shutter time is several seconds.

Maybe I was a bit harsh I my comment above, but still think a blower is not the right way, even if it has a filter. A blower sets air in motion, both inside and utside of the camera. A hurricane in the camera has no control of where the dust goes. The dust may blow of the censor (for now) and settle somewhere else inside. Also it may stir up old dust in there that now may settle on the censor instead. In my eyes a brush is even worse.
My point was only that if using a blower or brush I believe the potential of putting new dust on the censor is so high, that it’s hard to interpret any single spots. A more controlled cleaning method (which I think the O-ICK1 kit is) has to be used – I think.
Here are my pearls. Top view is how it looked a month ago, and the bottom how it is today.

I think this stain thing is taking off a bit too much. Seem every little dust and “stain” is interpreted as a sign of a defective censor.
I don’t think a blower is a good way to clean dust off the censor. The blower sucks dusty air from the outside, and blows it into the camera. I think that is something that should be avoided.
The Pentax O-ICK1 censor cleaning kit is a much better way, where one actually picks dust off the censor without blowing more dust in there.
I have the string of pearl stains, and will eventually send it in for a replacement. When I first noticed those stains there where also other single stains, some very blury ”oily” stains. After wet cleaning with censor swabs all those single stains were gone, but some new “stains” had been introduced. A couple of minutes with the O-ICK1 kit to remove those new dust “stains”, and the censor was pure and clean again – except for the “string of pearls” of course.

When I set RAW image viewing to “Actual Size” (where I guess it uses the RAW data) FastStone is not able to read K-5 PEF.

I’m using FastStone for quick and viewing, and for some quick and simple processing. The old version of FastStone is able to read the new K-5 PEFs without any update, while PhotoShop is not. How come a simple freeware software is able to do what the professional software is not???
Is FastStone actually working on the raw data in PEFs, or is there a jpg image stored in the PEF file that FastStone might be working on?

As Falk wrote, changing the focus, changes the effective aperture. The aperture makes a difference for the following reason:
Imagine a particle on the sensor that is lit with light rays that are perpendicular to the sensor. The particle would then create a sharply defined shadow on the sensor. This case, where no light rays can hit the sensor area hidden by the particle from the side is approximated by a very small aperture; the light rays almost come from the same point and there are few light rays that can illuminate the sensor area under the particle.

I get those “stains” in my shots. Tested with different lenses. Not dust, but that typical pattern of a string of drops as if something has splashed on to the sensor.
The stains get more visible/sharper at higher aperture. Also, they get sharper the closer I focus.
What I don’t understand is just that. Aperture and focus affects the image coming through the lens. (Maybe I’m dumb but...) How/why does it makes a difference if those stains are on the sensor itself?
(Tested with different lenses and it’s not the lens.)
