You doubt ? How can you make that assumption ? You doubt his gun was even loaded ? That's an astonishing remark to make.
You can see the kid with the gun ran because he was under fire - from that distance away it would be reasonable for him to assume that he would not win in a shoot-out since he was already under fire and he took the most logical course of action. I think the old guy continued shooting after they exited the building purely due to adrenaline rather than it being a conscious attempt to kill the guy on the ground. Seems the DA agrees with this interpretation.
Most shootings of innocent bystanders don't occur without some form of provocation - so anyone making any sort of move may have inadvertently instigated an attack, especially from an inexperienced kid. It is impossible for anyone to assume otherwise, and that this kid would not have shot someone, without being prejudiced.
