He can still appoint whomever he wants. He just has to wait for a recess.
Ordinarily though, doing that makes the president look bad; but since they have said up front that they will filibuster anyone, Obama can use that to his advantage. He can make a big deal of it an turn it around on them. All he has to do is use it as a reason for doing what he is going to do (before he makes the appointment), rather than making the appointment first, then trying to use it as an after action explanation.
He has a really great opportunity here if he plays it right.
